When you have been charged with an offence, a judge can choose to keep you in custody until your case is decided or you can be released on bail. The judge will make that decision at a bail hearing where we will make the best argument possible for your release. The Criminal Code reserves some of the strictest penalties in Canada for convictions of murder and manslaughter. As penalties upon conviction are potentially quite severe, it is essential that your defence is focused and unrelenting.

Murder can be in the first-degree or the second-degree. First-degree murder is a deliberate, pre-meditated act. Other scenarios that can give rise to a charge of first-degree murder include: contracted killings; a murder that happens while committing, or attempting to commit, a sexual assault; a murder that happens during a hostage taking; and a murder committed in conjunction with other crimes. Second-degree murder is any intentional killing that is not deemed first-degree.

Manslaughter is the charge that is a laid when someone’s culpability in someone’s death cannot be defined as a murder. It is a lesser charge than murder.

A quasi-criminal offence is an offence not covered by the Criminal Code or the Controlled Drugs and Substances Act. Such matters could be covered by a federal, provincial, or municipal law. Under the Highway Traffic Act, for example, this could include speeding offences or driving while uninsured.

For businesses and other organizations, quasi-criminal offences may be related to zoning violations, workplace health and safety issues, and employment standards, among others.
Court processes for these types of offences may be less complicated, or more so, depending on the statute, and the penalties can still be quite severe.
